Landmark Settlement in Arizona State University Title IX Rape Case

Firm partners Kerr and Hult announced the settlement of J.K. v. Arizona Board of Regents in January 2009. On the eve of trial in Phoenix federal court, the case settled for the second highest monetary payment in the history of Title IX sexual assault litigation (the largest settlement, in Simpson v. University of Colorado, was also obtained by the firm) plus historic statewide reforms. The Arizona Board of Regents committed to the five year appointment of a student safety czar with authority over sexual assault, harassment, and gender equity issues and proceedings on all public campuses in the state, enhancing the safety of some 123,000 students.

The case settled after Kerr and Hult obtained a precedent-setting opinion from District Judge Mary Murghia in federal court in Phoenix denying motions by the university and former ASU head football coach Dirk Koetter, and indicating severe sanctions were likely against the university for destroying key evidence in the case. The settlement drew widespread national attention, such as the ESPN story which can be found HERE, where a Harvard Law School expert called it "the turning point" for women's safety in college athletics.

CU and Lisa Simpson Settle 5-year Litigation

Baine Kerr, a partner of the firm, is pleased to announce the settlement of the Title IX litigation case between his client, Lisa Simpson, and the University of Colorado. The settlement was finalized after the 10th Circuit Court of Appeals reversed the District Court's ruling in favor of the University and returned the case for trial. The settlement includes a $2.5 million payment and the appointment of an independent adviser to monitor Title IX compliance and an additional part-time counselor who will work in CU's Office of Victim's Assistance. HBC partners Baine KerrKimberly Hult and Chris Ford led the team responsible for this historic outcome.

HBC Welcomes Angela L. Little as an Associate Attorney

HBC is pleased to welcome Angela Little as an associate attorney with the firm. Prior to joining HBC, Angela was a senior litigation associate for Smith Moore LLP, in its Greensboro, North Carolina office. Angela is a graduate of the University of Virginia School of Law, graduating Order of the Coif. Angela also received a B.A. degree in English from the College of William and Mary. Before attending law school, Angela served in the Peace Corps as a teacher of English language and literature in Tutume, Botswana. Angela's practice will continue to emphasize complex civil litigation matters.

HBC Welcomes Justin Konrad and Melissa Sullivan as New Associate Attorneys

HBC is pleased to welcome two new associates, Justin Konrad and Melissa Sullivan to the firm. Justin is a graduate of the University of Colorado School of Law, graduating in the top 2% of his class, and was a Casenote and Comment Editor for the University of Colorado Law Review. Justin attended Harvard University where he received his B.A. in Philosophy. Prior to starting with HBC, Justin served as a judicial clerk for the Hon. David Ebel, Senior Judge for the 10th Circuit Court of Appeals. Justin's practice will focus on business and transactional matters. Melissa finished first in her class at the University of Denver Sturm College of Law and served as an Articles Editor for the University of Denver Law Review. She received a B.S. degree in Secondary Mathematics Education from Temple University and, prior to law school, Melissa taught high school mathematics in South Carolina and Illinois, and she also worked with students learning English as a second language.  Melissa's practice will encompass both litigation and transactional matters.

Bill Meyer selected to receive the American Bar Association's Rule of Law Award

Bill Meyer was selected to receive the Rule of Law Award from the ABA Rule of Law Initiative (ROLI) for his significant international pro bono work with Central European and Eurasian Law Initiative (CEELI) and other ABA sponsored groups. Bill will receive the award at a dinner in San Francisco in August. He will share the podium with the co-awardee, U.S. Supreme Court Justice Stephen Breyer.

Chris Ford appointed to the Board of The Colorado Legal Aid Foundation and name Co-Chair of the Boulder County Campaign

Chris Ford has been appointed as a Trustee to serve on the Board of Trustees for The Legal Aid Foundation of Colorado and has been named a Co-Chair of the Boulder County Campaign. The Colorado Legal Aid Foundation works to increase and diversify funding to support civil legal services for Colorado's poor and disadvantaged people. By raising private funds for legal services, the Foundation works to ensure that Colorado's low-income population receives the civil legal assistance they need.
